Survey readiness for Florida health care clinics

Florida licenses health care clinics under the Health Care Clinic Act, Chapter 400, Part X, Florida Statutes, with details in rule chapter 59A-33 of the Florida Administrative Code and the general licensing rules in Chapter 408, Part II. The law exists largely to prevent fraud, so a clinic inspection centers on one person: the medical or clinic director, and whether they are really doing the job the law gives them.

License or exemption?

Depending on who owns them, many clinics are exempt from licensure and hold a certificate of exemption instead of a license. Ownership changes can affect which one you need, so review your status before any change happens. Operating without the right license or exemption is a serious violation.

What surveyors focus on

• The medical or clinic director. Whether you have a qualified director, and whether their role is clearly documented.
• The director’s duties. Records showing the director actually carries out the responsibilities the law assigns, including reviews of licenses, referrals and billing.
• Postings. The notices and price information the law requires patients to see.
• Staff and records. Licenses and credentials for clinical staff, background screening, and patient and billing records that support each other.
• Equipment. Certifications and accreditations where your services require them.

Inspections happen at initial licensure, renewal, change of ownership and after complaints, and the director is expected to take part.

Where clinics commonly slip

• Reviews that happen but are not written down. If it is not documented, it is treated as not done.
• Directors who are involved on paper only.
• Postings that are missing or out of date.

How to prepare
